BOOKING TERMS AND CONDITIONS
Your chosen dates will only become secured and guaranteed when the completed booking form and deposit (as specified in the rates) have been received.
The lead named making the reservation with us enters into a binding contract that will come into existence when we dispatch a confirmation account to you. Your contract with us is governed by English Law and is subject to the exclusive jurisdiction of the courts of England and Wales. In all cases the lead named member accepts these booking conditions not only for him/herself but also on behalf of and with the assumed consent of all persons included in the reservation and is therefore presumed to have assumed their liabilities and responsibilities in the terms thereof. The booking conditions apply for all types of reservation methods ie telephone, e-mail, in person, postal or facsimile. To comply with Florida State Law a completed booking form must be returned to Suzanne and Colin Reid showing the total number of persons to reside in the property. Flights/car hire/travel insurance are subject to the terms and conditions of the ATOL/ABTA holder with whom they are booked and details will be supplied by them.
DEPOSIT/FINAL PAYMENT PROCEDURE
A deposit (as set out in the rates) must be made to secure your reservation. This deposit forms part of the total cost and is not refundable or transferable. The balance of the cost of your reservation plus a fully refundable security deposit (as set out in the rates) will become due 10 weeks before your arrival date. The security deposit will be refunded within seven days from the date of your departure after a full inspection of the home has has been completed. In the event of there being damage or missing items, we will contact you prior to your deposit being returned. For reservations made less than 10 weeks prior to the arrival date, the full hiring charge and refundable security deposit will become due immediately. We will send you a reminder of balances due. Failure to pay the balance when due will entitle us to cancel your reservation, but you may still remain liable for amounts due as follows:
Cancellation up to 10 weeks prior to arrival - Loss of deposit only
Cancellation 6-10 weeks prior to arrival - loss of 50% of total amount
Cancellation 0-6 weeks prior to arrival - loss of the full amount
Balances can be paid by personal cheque, money order, travellers cheques or bankers draft or using the Paypal system.
TERMS
The accommodation is reserved exclusively for you and your party named on the booking form and cannot be sub-let or assigned. No other persons should use the accommodation. Rental charges are fully inclusive of all taxes, electricity, water, cable TV and internet, local and national telephone calls and cleaning fees (subject to additional cleaning fees for short stays as detailed in the rates). Pets are not allowed unless by prior arrangement. The condo will available from 4.00pm local time on the date of your arrival and must be vacated by 11.00am local time on the date of your departure to allow access for the cleaners - unless otherwise agreed by the management company/owners. Failure to vacate at the agreed time may render you liable to incur charges equivalent to one day's accomodation cost. Charges will be levied for every day thereafter including any other expenses incurred by the management company and the owners in the process of eviction.
SECURITY OF THE PROPERTY AND ITS CONTENTS
The home must be made available for inspection at any reasonable time for the homeowners' management company. Whilst we understand that there are bound to be odd minor breakages (eg glass or plates), you will be required to cover the cost of any breakages/damage or loss to the property and will be expected to keep the property in a clean and habitable state. If the property requires excessive cleaning then you will be billed for the amount deemed necessary by the homeowners' management company. We have tried to equip our home with many items which we hope will make for a more comfortable stay (eg beach towels, tennis rackets, playstation etc) and whilst we hope that you do use them as your own whilst you are staying in our home we would ask that you do not remove them from the condo when you leave - you will be billed for any missing items!
CANCELLATION OR AMENDMENTS BY YOU
If you are compelled to cancel your reservation, you should inform us immediately via e-mail or telephone. In this event, the following refunds will be processed:
Cancellation up to 10 weeks prior to arrival - Loss of deposit only
Cancellation 6-10 weeks prior to arrival - loss of 50% of total amount
Cancellation 0-6 weeks prior to arrival - loss of the full amount
If you need to amend your reservation, we will try to accommodate this but should this prove impossible, the above refunds only will apply.
CANCELLATION BY US THE OWNERS
In the event of circumstances beyond our control requiring us to cancel a reservation eg acts of God, civil disturbance, riots, flood, drought, fire and legislation, only repayment in full of any monies paid in respect of the reservation will be made. We will do everything in our power to find suitable alternative accommodation through local management companies but do not accept any laibility whatsoever in respect of any loss or damage sustained in these cirumstances. If an offer of alternative accommodation is not acceptable to you, you will be entitled to a full refund of any monies paid. We do not however accept liability in any way for disruption, delay or cancellation of your vacation due to any circumstances beyound our control including personal loss, damage, injury or death. We recommend that you ensure that you have adequate insurance cover for your vacation.
INSURANCE
To comply with EC Regulations and for your own protection all hirers should ensure that they have adequate personal and cancellation insurance protection.
LIABILITY
We do not accept any liability for any injury sustained by or to you or any other visitor to the condominium or swimming pool unless we, the owners, are proved to be negligent. Nor will be held liable for any loss or damage however caused to any property or possessions brought into the premises. Without any restriction we will not be liable for any loss or damage arising in connection with your stay in the condominium caused by any matter outside our reasonable control including Acts of God, war, civil disturbances, strikes or other industrial action, closure of airports, weather conditions, failure of public supplies such as water supply, sewerage, electricity or air conditioning. Nor will we be liable for the consequences of the actions or omissions of persons who may control or supply main services, or any actions taken in the vicinity of the property reserved, by any authority over which we have no control. This does not affect your statutory rights as a consumer.
COMPLAINTS
The management company who look after the property will always do its best to ensure that the condominium is clean upon arrival of our guests. It is essential that any defect, shortage or complaint is reported to them immediately in order that the problem can be resolved as soon as possible. Should any problem arise whilst you are there please advise us immediately in order that we can follow this up with the management company - we would rather have the opportunity to put the problem right straightaway ensuring that the complaint does not ruin/affect your vacation rather than receiving a complaint when you return.
